Pollution certificate for small scale industries

A pollution control certificate for small-scale industries is issued by the state pollution control board. This certificate is required to operate a factory or industrial unit in India. The pollution control board will issue this certificate after verifying that the industrial unit has adequate pollution control measures in place. 

A pollution control certificate is a document issued by the concerned pollution control board to an entity or individual that has completed the process of obtaining it. A pollution control certificate is required for several activities and processes, including those related to construction, transportation, and manufacturing.

 

The main purpose of obtaining a pollution control certificate is to ensure that no harmful waste products are released into the environment. This helps protect public health and also ensures that any damage caused by industrial processes does not impact the environment or surrounding communities.

Pollution Certificates for small scale industries are required by manufacturing, construction, transportation, etc., in order to comply with laws regarding environmental protection and safety standards. In essence, this document provides proof that certain rules have been complied with so that there are no negative effects on the environment or human health.

Pollution Control Board 

The Pollution Control Board is responsible for issuing pollution certificates to the industrial units in its jurisdiction. The board certifies that the factory meets all environmental norms and standards.

Required consent certificates for Pollution license

  • Consent to Establish: To establish a new factory or plant, an applicant needs to obtain consent from the State Pollution Control Board (SPCB) in the form of Consent to Establish (CTE). This is one of the most important prerequisites for setting up a new industry in India. The CTE is issued by the SPCB based on its assessment of the environmental impact assessment report submitted by the applicant.

 

  • Consent to Operate: All factories and industries have to obtain Consent to Operate (CTO) from SPCB before they start their operations. A company can apply for CTO when it has completed construction of its factory or plant but before it starts production. Once issued, a CTO is valid for 5 years and can renew after that period if required. The process of obtaining a CTO involves reviewing and evaluating environmental compliance measures followed by a detailed inspection of the site and facilities by SPCB officials.

The eligibility criteria for obtaining a pollution license are as follows:

  1. The applicant should be a registered company.
  2. The applicant should be having a valid trade license or other valid permission issued by the concerned authority for carrying out the activity of manufacturing, processing, storing, or handling hazardous waste.
  3. Applicant should have adequate infrastructure and facilities in place to ensure the safe storage and disposal of hazardous waste generated during the operation of the business.
  4. The applicant should have adequate financial resources to meet all obligations under any law relating to the environment, health, and safety at the workplace, etc.,

Documents Required For CTO/CTE:

The following is a list of general documents that must be provided in order to receive a CTO/CTE.

  • Satellite view of the project site
  • The project location’s layout
  • Report on the project, including production procedures and raw materials.
  • Proof of Investment
  • Environmental declaration
  • Form for NOC Compliance Report/Consent Conditions
  • Certificate of completion of the wastewater treatment plant or of any other pollution control measures
  • Environment clearance criteria compliance
